Jon Gosselin to battle Kate Gosselin in court for his children

JON GOSSELIN is not happy with her ex-wife Kate Gosselin because he thinks that his ex-wife is spending too much time for the reality show "Dancing With the Stars" performance and not enough with their kids. The former Jon & Kate Plus 8 star is reportedly preparing to ask a judge to grant him primary custody so that he can spend time with his children as Kate is busy with her work.

Jon Gosselin's lawyer, Anthony F. List, told a website that his client Jon is ready to appeal for primary custody of his eight children with ex-wife Kate Gosselin. Anthony called her an "absentee mom" who does not spend enough "quality time with the 8 kids."

Gosselin allegedly plans to use his ex-wife's performance on "Dancing With the Stars" as evidence that she is ignoring their children in favor of her career.Jon Gosselin is also planning to ask for spousal and child support from Kate Gosselin, a reverse of the judge's previous ruling.

Jon's lawyer also added that it was ridiculous for Jon Gosselin to be paying his ex-wife $20,000 a month for child support when she is allegedly not spending any time with the kids. Jon is very angry that his children are getting no care from there mother.

Since Jon Gosselin is jobless at the moment, he may be doing this to save his monthly expense $20,000 which he is spending to support his children, and may be he is thinking that she will start paying him spousal support.

However, it seems like Jon may seek primary custody of their eight kids, as said by his new lawyer. Anthony List, says he'll claim Kate is an "absentee mom" because of her Dancing With The Stars gig and will sue her.

In response, Kate's lawyer Mark Momijan told an online channel that "We haven't received any formal filing yet, but I can't imagine anything farther from the truth. Kate is a devoted mother. Her concern for the welfare of her kids is so prominent that any allegations like this report are reckless and so far from the mark, it's offensive."
